Section 4-89-105 - Damages

For a violation which is subject to the provisions of this chapter, the consumer shall recover from the persons violating this chapter an amount equal to:(1) Ten percent (10%) of the transaction total or one hundred dollars ($100), whichever is greater; and(2) The actual damages, including any incidental, consequential, and special damages sustained by the consumer as a result of the violation.Acts 1973, No. 462, § 9; A.S.A. 1947, § 70-922.
