Section 5-60-115 - Filling or covering abandoned water wells

(a) When the owner of land abandons or ceases to use any dug water well located on the land, he or she shall either fill the well or place a sturdy cover over the well to prevent animals and persons from falling into the well.(b) Any person who willfully fails or refuses to either fill or cover the well, as provided in subsection (a) of this section, is guilty of a violation and upon conviction is subject to a fine of not less than ten dollars ($10.00) nor more than fifty dollars ($50.00).Acts 1967, No. 193, §§ 1, 2; A.S.A. 1947, §§ 41-3755, 41-3756; Acts 2005, No. 1994, § 52.
