Section 5-64-1201 - Possession

(a) It is unlawful for any person to possess a substance listed in subsection (b) of this section: (1) With the intent to breathe, inhale, ingest, or use the substance for the purpose of: (A) Causing a condition of intoxication, elation, euphoria, dizziness, stupefaction, or dulling of the senses; or(B) In any manner changing, distorting, or disturbing his or her audio, visual, or mental processes; or(2) Who purposely is under the influence of the substance.(b) This subchapter applies to the following substances:(1) Nitrous oxide, commonly known as 'laughing gas';(2) Any compound, liquid, or chemical that contains nitrous oxide; or(3) Any amyl nitrite, commonly known as 'poppers' or 'snappers'.(c) Upon conviction, a person who violates this section is guilty of a Class A misdemeanor.Acts 1997, No. 355, § 1; 2001, No. 1553, § 13; 2007, No. 827, § 72.
