(a) A person shall not sell, rent, or transfer a firearm to any person whom he or she knows is prohibited by state or federal law from possessing the firearm.(b)(1) Violation of this section is a Class A misdemeanor, unless the firearm is: (A) A handgun;(B) An explosive or incendiary device, as defined in § 5-71-301;(C) A defaced firearm, as described in § 5-73-107; or(D) Other implement for the infliction of serious physical injury or death that serves no lawful purpose.(2) If the firearm is listed in subdivision (b)(1) of this section, a violation of this section is a Class B felony.Amended by Act 2019, No. 1051,§ 4, eff. 7/24/2019.Amended by Act 2019, No. 495,§ 4, eff. 7/24/2019.Acts 1999, No. 1558, § 3.
