California Legal Code
21422. Every member retired for disability for whom a different disability retirement allowance is not prescribed by any other provision of this article, including a member who is entitled to an industrial disability retirement allowance if the disability is industrial but who retires for nonindustrial disability shall receive a disability retirement allowance which shall consist of:(a) An annuity that is the actuarial equivalent of his or her accumulated contributions at the time of retirement; and(b) If, in the opinion of the board, his or her disability is not due to intemperance, willful misconduct or violation of law on his or her part, a disability retirement pension derived from the contributions of the employer.(Repealed and added by Stats. 1995, Ch. 379, Sec. 2. Effective January 1, 1996.)
