31663.25. (a) Except as provided in Section 31663.26, a safety member who has reached the applicable compulsory age of retirement, if any, or a safety member who has completed 10 years of continuous service and who has reached the age of 50, or a safety member who has completed 20 years of service regardless of age, may be retired upon filing with the board a written application setting forth the date upon which the member desires the member’s retirement to become effective. The effective retirement date shall not be either of the following:(1) Earlier than the date the application is filed with the board.(2) More than 60 days after the date of filing the application or more than a number of days that has been approved by the board.(b) This section shall not apply to a member who is subject to the provisions of the California Public Employees’ Pension Reform Act of 2013 (Article 4 (commencing with Section 7522) of Chapter 21 of Division 7 of Title 1) for all or any portion of that member’s membership in the county retirement system.(Amended by Stats. 2022, Ch. 231, Sec. 10.
