31672.3. A member of a county retirement system who is subject to the California Public Employees’ Pension Reform Act of 2013 (Article 4 (commencing with Section 7522) of Chapter 21 of Division 7 of Title 1) for all or a portion of the member’s membership in the county retirement system who has completed five years of service and has reached the minimum retirement age applicable to that member under the act, or has reached 70 years of age, may be retired upon filing with the board a written application, setting forth the date upon which the member desires the member’s retirement to become effective. The effective retirement date shall not be either of the following:(1) Earlier than the date the application is filed with the board.(2) More than 60 days after the date of filing the application or more than a number of days that has been approved by the board.(Amended by Stats. 2020, Ch. 275, Sec. 47. (AB 2101) Effective January 1, 2021.)
