Colorado Legal Code
(1)(a) There is hereby created in the division of real estate a board of mortgage loan originators, consisting of five members appointed by the governor with the consent of the senate.(b) Of the members of the board: (I) Three must be licensed mortgage loan originators. The general assembly encourages the governor to appoint to at least one of these three positions a licensed mortgage loan originator who is an employee or exclusive agent of, or works as an independent contractor for, a Colorado-based mortgage company.(II) Two must be members of the public at large not engaged in mortgage loan origination or mortgage lending.(c) The term of office for a member is four years; except that the terms shall be staggered so that no more than three members' terms expire in the same year.(d) In the event of a vacancy by death, resignation, removal, or otherwise, the governor shall appoint a member to fill the unexpired term. The governor has the authority to remove any member for misconduct, neglect of duty, or incompetence.(2)(a) The board is a type 1 entity, as defined in section 24-1-105, and exercises its powers and performs its duties and functions under the department.(b)
