Section 14-13-106 - Priority

Ask AI about this
If a question of existence or exercise of jurisdiction under this article is raised in a child-custody proceeding, the question, upon request of a party, must be given priority on the calendar and handled expeditiously.L. 2000: Entire article R&RE, p. 1521, § 1, effective July 1.This section is similar to former § 14-13-125 as it existed prior to 2000.OFFICIAL COMMENT No substantive change was made to this section which was Section 24 of the UCCJA. The section is placed toward the beginning of part 1 to emphasize its importance. The language change from 'case' to 'question' is intended to clarify that it is the jurisdictional issue which must be expedited and not the entire custody case. Whether the entire custody case should be given priority is a matter of local law.
