§ 19-5-5-202

(1) This part 2 does not apply to a transfer of custody of a child by a parent, guardian, or custodian of the child to: (a) A parent of the child;(b) A stepparent of the child;(c) An adult who is related to the child by blood, marriage, adoption, or other relationship recognized by other law of this state;(d) An adult who, at the time of the transfer, had a meaningful and safe relationship with the child for a period of at least six months prior to the transfer, and whom the parent, guardian, or custodian reasonably believes, at the time of the transfer, to be a fit custodian of the child; or(e) An Indian custodian, as defined in the federal 'Indian Child Welfare Act of 1978', 25 U.S.C. sec. 1903(6), as amended, of the child.Added by 2023 Ch. 86,§ 1, eff. 4/17/2023.
