Section 24-75-115 - Use of state funds - marketing featuring elected officials - prohibition

(1) A county clerk and recorder or designated election official who is administering an election and the department of state shall not use any appropriation of state or federal money to pay for advertising expenses that prominently feature a person who is a declared candidate for a federal, state, or local office for a future election. For purposes of this section, advertising does not include: (a) Official notices or communications that are required or authorized by law; or(b) Ongoing and routine communications, such as maintaining or publishing content on the website of the county clerk and recorder or designated election official or the secretary of state.Added by 2023 Ch. 399,§ 54, eff. 6/6/2023.
