Section 26-7-110 - Appeals

(1) In any decision made pursuant to this article 7, the adoptive parents have the right to appeal to the state department, with a hearing before a state department administrative law judge in accordance with the 'State Administrative Procedure Act', article 4 of title 24.(2) The following situations are subject to appeal:(a) A determination of a child's or youth's eligibility for benefits pursuant to section 26-7-105;(b) Any determination, redetermination, or reduction of benefits pursuant to this article 7;(c) Termination of the agreement entered into pursuant to section 26-7-107; or(d) The failure of the state department, county department, or nonprofit child placement agency to notify the adoptive family of an eligible child or youth about the availability of benefits pursuant to this article 7.Added by 2019 Ch. 180, § 1, eff. 8/2/2019.L. 2019: Entire article R&RE, (SB 19-178), ch. 2048, p. 2048, § 1, effective August 2.
