Section 33-61-105 - Registration required - petty offense - civil penalty

(1) Every producer liable for the production fee for wildlife and land remediation and the production fee for clean transit shall file a registration statement on a form prescribed by the executive director on or before July 1, 2025, or on or before the date of first production, whichever is later.(2)(a) Any producer that produces oil or gas on or after July 1, 2025, in the state without registering in accordance with subsection (1) of this section commits a petty offense and shall be punished in accordance with section 18-1.3-503.(b) The executive director shall also assess a civil penalty of fifty dollars per day to a maximum penalty of one thousand dollars against any producer that produces oil or gas in the state on or after July 1, 2025, without registering as set forth in subsection (1) of this section. The executive director shall assess and collect and transmit the civil penalty imposed by this subsection (2)(b) to the state treasurer, and the state treasurer shall credit the civil penalties transmitted in the same manner as the production fee for wildlife and land remediation and the production fee for clean transit.
