Section 43-1-1403 - Authority to use a design-build contract process

Notwithstanding any other provision of law to the contrary, the department may select a design-build firm and award a design-build contract for a transportation project as provided in this part 14. The department may include a warranty provision in any design-build contract that requires the design-build firm to perform maintenance services on the completed transportation project.L. 99: Entire part added, p. 258, § 1, effective April 9.
