(1) An optional premises license shall be granted for optional premises approved by the state and local licensing authorities to persons selling alcohol beverages by the drink only to customers for consumption on the optional premises and for storing alcohol beverages in a secure area on or off the optional premises for future use on the optional premises.(2)(a) It is unlawful for any owner, part owner, shareholder, or person interested directly or indirectly in an optional premises license to conduct, own either in whole or in part, or be directly or indirectly interested in any other business licensed pursuant to this article 3 or article 4 of this title 44.(b) Notwithstanding subsection (2)(a) of this section, an owner, part owner, shareholder, or person interested directly or indirectly in an optional premises license may own, either in whole or in part, or be directly or indirectly interested in a license described in section 44-3-401 (1)(j) to (1)(t), (1)(v), or (1)(w), 44-3-412 (1), or 44-4-104 (1)(c) or in a financial institution referred to in section 44-3-308 (4).Renumbered from C.R.S. § 12-47-413 and amended by 2018 Ch. 152, § 2, eff. 10/1/2018.Amended by 2016 Ch. 3-412 (1), or 44-4-104 (1)(c) or in a financial institution referred to in section 44-3-308 (4).Renumbered from C.R.S. § 12-47-413 and amended by 2018 Ch. 152, § 2, eff. 10/1/2018.Amended by 2016 Ch. 312, § 10, eff. 8/10/2016.Amended by 2015 Ch. 121, § 13, eff. 4/24/2015.L. 2018: Entire article added with relocations, (HB 18-1025), ch. 152, p. 1019, § 2, effective October 1.This section is similar to former § 12-47-413 as it existed prior to 2018.
