(a) No person shall operate or attempt to operate any aircraft or unmanned aircraft on the ground or in the air while under the influence of intoxicating liquor or of any drug.(b) No person shall operate or attempt to operate any aircraft on the ground or in the air carrying passengers who are under the influence of intoxicating liquor or of any drug.(c) Any person who violates any provision of this section shall, for a first offense, be guilty of a class C misdemeanor and, for any subsequent offense, be guilty of a class A misdemeanor.(1949 Rev., S. 4822; P.A. 12-80, S. 144; P.A. 24-40, S. 38.)History: P.A. 12-80 inserted Subsec. designators (a), (b) and (c) and amended Subsec.
