(a) The existence of a nonmaterial fact concerning real property is not a material fact that must be disclosed in a real estate transaction.(b) No cause of action shall arise against an owner of real estate, the owner's agent or any agent of the transferee for the failure to disclose a nonmaterial fact concerning real property to the transferee.(P.A. 90-141, S. 2; P.A. 97-172; P.A. 04-39, S. 2.)History: P.A. 97-172 amended Subsec. (b) to include any agent of the transferee; P.A. 04-39 replaced provisions re psychological impact with references to 'a nonmaterial fact concerning real property' and, in Subsec.
