When any person places or keeps building materials, or any obstacle, in any highway, either with or without a license therefor from the town, city or borough in which such highway is situated, he shall pay to such town, city or borough all costs and damages which it sustains or is compelled to pay by reason thereof.(1949 Rev., S. 8299.)Open sewer box on sidewalk not an obstacle. 91 C. 255.
