In any action to enforce the provisions of sections 9-368i to 9-368o, inclusive, the court may award reasonable attorneys' fees and litigation costs, including, but not limited to, expert witness fees and expenses, to the party that filed such action, other than the state or any municipality, and that prevailed in such action. The party that filed such action shall be deemed to have prevailed when, as a result of litigation, the party against whom such action was filed has yielded much or all of the relief sought in such action. In the case of a party against whom such action was filed and who prevailed in such action, the court shall not award such party any costs unless such court finds such action to be frivolous, unreasonable or without foundation.(P.A. 23-204, S. 418.)History: P.A. 23-204 effective July 1, 2023.
