(a) Nothing in this chapter precludes a law-enforcement officer from removing firearms under other authority or the filing of criminal charges when probable cause exists. (b) A law-enforcement agency is immune from civil or criminal liability for any damage or deterioration of firearms stored or transported under this chapter. This subsection does not apply if the damage or deterioration occurred as a result of recklessness, gross negligence, or intentional misconduct by the law-enforcement agency or federally-licensed firearms dealer.83 Del.
