(a) A person is guilty of desecration if the person attempts or does intentionally deface, damage, pollute or otherwise physically mistreat any of the following: (1) A burial place. (2) A public monument or structure. (3) A place of worship or place primarily used for religious purposes. (4) A school, educational institution, or community center. (b) (1) Any person who commits desecration of a burial place is guilty of a class A misdemeanor and upon conviction the court may impose a fine of up to $2,300. (2) Any person who commits desecration under paragraph (a)(2) through (a)(4) of this section is guilty of a class A misdemeanor. (3) The penalty for a violation of this section may include restitution and 250 hours of community service. (c) The Superior Court has exclusive jurisdiction over a violation of this section.11 Del.
