(a) Any person who resides in the city, town or county in which the Department has determined a need for a correctional facility may bring an action in a court of proper jurisdiction if the Department has not followed the site selection process set forth in this subchapter. (b) An action brought under this section shall not be maintained if it is filed more than 60 days after the Department formally announces its final site selection.67 Del. Laws, c. 254, § 1;
