01. Performance Parking Program Fund. (a) There is established as a nonlapsing fund the Performance Parking Program Fund ('Fund'), which shall be administered by the Director of the District Department of Transportation in accordance with subsections (b) and (c) of this section. (b) All parking-meter revenue collected within the Greater U Street Performance Parking Zone established by § 50-2538 that exceeds baseline revenue from metered spaces within the zone as of October 1, 2023, as determined by the Director of the Department of Transportation, shall be deposited in the Fund. (c) Money in the Fund shall be used for the following purposes: (1) Up to 60% shall be used to repay the cost of procurement and maintenance of new meters and related signage for the pilot program in the Greater U Street Performance Parking Zone; (2) Once the cost of meter procurement is paid in full for the Greater U Street Performance Parking Zone, up to 5% shall be used to pay for meter maintenance and related signage in that zone; and (3) The remaining balance shall be used solely for the following purposes within and immediately adjacent to the Greater U Street Performance Parking Zone: (A)

(d)(1) The money deposited into the Fund but not expended in a fiscal year shall not revert to the unassigned fund balance of the General Fund of the District of Columbia at the end of a fiscal year, or at any other time. (2) Subject to authorization in an approved budget and financial plan, any funds appropriated in the Fund shall be continually available without regard to fiscal year limitation. (Nov. 25, 2008, D.C. Effect of Amendments The 2012 amendment by D.C. Law 19-168 rewrote (a); and added 'projects within the zone from which revenues were raised for' in (b). The 2013 amendment by D.C.
