§ 161.36

161.36 General powers of authority.—In order to most effectively carry out the purposes of this part, the board of county commissioners, as the county beach and shore preservation authority and as the governing body of each beach and shore preservation district established thereby, shall be possessed of broad powers to do all manner of things necessary or desirable in pursuance of this end; provided, however, nothing herein shall diminish or impair the regulatory authority of the Department of Environmental Protection under part I of this chapter or the Board of Trustees of the Internal Improvement Trust Fund under chapter 253. Such powers shall specifically include, but not be limited to, the following:(1) To make contracts and enter into agreements;(2) To sue and be sued;(3) To acquire and hold lands and property by any lawful means;(4) To exercise the power of eminent domain;(5) To enter upon private property for purposes of making surveys, soundings, drillings and examinations, and such entry shall not be deemed a trespass;(6) To construct, acquire, operate and maintain works and facilities;(7) To make rules and regulations; and(8) To do any and all other things specified or
