Section 2-11-28 - Powers and duties of Commissioner - Rule-making authority

The Commissioner shall have authority to promulgate and enforce such rules and regulations as the Commissioner may deem necessary to carry out or make effective this article. Such rules and regulations may:(1) Provide such additional definitions of terms as the Commissioner believes are needed;(2) Provide a noxious weed list and add to or subtract therefrom from time to time;(3) Prescribe minimum standards of germination and purity and maximum amounts of inert matter and weed seed;(4) Prescribe the maximum number of weed seeds per pound allowed for each type of restricted noxious weed;(5) Specify the methods of sampling, inspecting, analysis, testing, and examination of seed and the tolerance to be followed in the administration of this article, which shall be in general accord with the officially prescribed practice in interstate commerce;(6) Prescribe the form of tags or labels;(7) Fix the number of tests allowed to any one person, firm, corporation, etc.;(8) Fix charges for tests made;(9) Prescribe minimum standards for seed vigor when such standards have been developed and standardized by the Association of Official Seed Analysts (AOSA) and to require the results of any seed
