Section 38-2-1090 - Assaulting or willfully disobeying officer

Any person subject to this article who:(1) Strikes his or her superior commissioned officer or draws or lifts up any weapon or offers any violence against said superior commissioned officer while he or she is in the execution of his or her office; or(2) Willfully disobeys a lawful command of his or her superior commissioned officer shall be punished, if the offense is committed in time of war, by confinement of not more than ten years or such other punishment as a court-martial may direct, or if the offense is committed at any time other than a time of war, by such punishment as a court-martial may direct.Added by 2015 Ga.
