In order to promote the general welfare of the inh abitants of the Territory of Guam through the improvement of ho using standards, housing supply and housing affordability in Guam, there is created a body corporate to be known as th e Guam Housing Corporation, hereinafter referred to as the 'Housing Corporation.' Authorized Activities of Corporation. The Housing Corporation is authorized to engage in the following activities when it finds that such activi ties will further the purposes of this Chapter and will not conflict with the encouragement and promotion of private enterprise i n the territory of Guam: (a) To encourage and promote the investment of private capital in low and moderate income resident ial housing in Guam. The Housing Corporation shall form ulate its policies so as to encourage and promote the inv estment of capital owned by residents of Guam. (b) To engage in land-use planning for residential housing purposes to the end that the most economic and socially beneficial use may be made of land, and to encourage and assist private persons and organizati ons to act in accordance with the results of such

(2) Loans shall be made to residents of Guam to enable them to purchase or construct permanent home s which are insurable under a standard Guam Home Owner’s

(6) Loans shall be given only to residents who have been unable to obtain conventional financing from mortgage lending institutions, including, but not limited to, banks and savings and loan associations . (2) To assist in the development of tourist hotel facilities as provided in this Chapter. (e) To make a low interest loan to any homeowner whose living space in his primary residence was dam aged as a result of the earthquake on Guam on August 8, 1993 to repair such residence; provided, that the homeowner did not have insurance to cover the loss and did not qualif y for a loan from the U.S. Small Business Administration su fficient to complete the earthquake repair, or from any othe r financial institution. First priority for such loan s shall be given to those homeowners whose primary residence i s mortgaged to the Housing Corporation. (f) To encourage and promote the purchase or construction of affordable, typhoon-resistant, perm anent

Pro vided, however, that (1) in the case of activities of a predominantly no n- revenue-producing character the expenses shall not exceed the amounts of the grants for these activities, and that (2) the funds granted under this Subsection shall b e expended only upon certification by a

(a) The management of the Housing Corporation shal l be vested in a Board of Directors consisting of seven (7) members including a chairman who shall be appointed by the Governor of Guam, with the advice and consent of the Legislatur e. (1) The Directors shall serve for a period of six (6) years, except that (A) any director appointed to fill a vacancy occurring prior to the expiration of the term for w hich his predecessor was appointed, shall be appointed f or the remainder of such term, and (B) the terms of office of the directors first taki ng office after June 30, 1963, shall expire, as design ated by the Governor at the time of appointment, one (1) the end of two (2) years, one (1) at the end of four (4 ) years, one (1) at the end of six (6) years, and one (1) at the end of eight (8) years, after June 30, 1963.
