The Educator Corps Council shall consist of seven ( 7) members. These members are: the administrative chair of the School of Education of the College of Professional Studies or its successor in interest of the University of Guam; the Personnel Administrator of the Departm ent of Education or its successor in interest; the Associate Superintendent for Special Education of the Department of Education or its successor in int erest; a school principal from the Department of Education or its successor i n interest; a guidance counselor from the Department of Education or its s uccessor in interest; a secondary school teacher who has been a master teac her e Department of Education or its successor i n interest; a guidance counselor from the Department of Education or its s uccessor in interest; a secondary school teacher who has been a master teac her for at least one (1) semester from the Department of Education or its su ccessor in interest, or the Guam Community College; and an elementary school te acher who has been a master teacher for at least one (1) semester from the Department of Education or its successor in interest. The princip al, guidance counselor and teachers shall be appointed by the Superintendent o f Education. The members of the Council shall elect a chairperson fr om among themselves to preside over all meetings of the Council. The Schoo l of Education of the University of Guam shall provide logistics and pers onnel necessary for the operation of the Council, and the University of Gua m shall serve as the custodian for the Program's funds and records. The Educator Corps Administrator shall be a faculty member of the Scho ol of Education and shall serve in a non-voting, ex-officio capacity as the Executive Secretary of the Council. Yamashita Educator Corps Council shall advise the School of Education of the University of Guam regar ding the professional education programs contained in this Chapter as the y relate to the recruitment and education of prospective teachers, counselors and school administrators and continuing education requirement s for the recertification of teachers. Budget and Compensation. The budget for salaries, stipends, travel and opera tional requirements shall be submitted annually by the School of Educat ion for approval by I Liheslaturan Guahan . I Liheslaturan Guahan shall appropriate funds to the University of Guam which shall disburse them pursua nt to the directives and policies of the School of Education. Unexpended fun ds shall be maintained in a continuing budget appropriation for use by the School of Education only for purposes authorized in this Section in succeedi ng budget cycles. § 18106. Prior Appropriations to the Guam Teacher C orps. All funds appropriated to the Guam Teacher Corps pr ior to the enactment of this Article shall be deemed as approp riated to The Dr. Antonio C. Yamashita Educator Corps. § 18107. Guam Teacher C orps. All funds appropriated to the Guam Teacher Corps pr ior to the enactment of this Article shall be deemed as approp riated to The Dr. Antonio C. Yamashita Educator Corps. § 18107. Garnishment of Income Tax Refunds in the E vent of Default. The Dr. Antonio C. Yamashita School of Education ma y, subject to the terms and conditions of a Memorandum of Understandi ng with the Department of Revenue and Taxation, garnish the tax refunds due to any recipient of assistance pursuant to this Chapter an d/or the recipient’s co- signer(s) who has defaulted on the repayment of suc h assistance and a judgment has issued. If any part or provision of this Chapter, or the ap plication of this Chapter to any person or circumstance, is held inva lid, the remainder of this Chapter, including the application of such part or provisions to other persons or circumstances, shall not be affected by such a h olding and shall continue in full force and effect. (a) The Guam Teacher Corps shall consist of studen ts who have declared their intention to become educators and wh o are enrolled in the teacher educational programs at the University of G uam, or if such programs are not available at the t of studen ts who have declared their intention to become educators and wh o are enrolled in the teacher educational programs at the University of G uam, or if such programs are not available at the University of Guam, at oth er accredited institutions which have been approved by the School of Education and who have been duly accepted into the Guam Teacher Corps Scholarsh ip Program. (b) Scholarship and financial assistance may be aw arded to eligible students who meet the following criteria: (1) are bona fide residents of Guam; (2) are citizens or permanent resident aliens of th e United States; (3) are seniors or graduates of an accredited high school with an overall grade point average of not less than 2.5 on a 4.0 scale; (4) have been admitted to the University of Guam in accordance to its admissions policies; (5) maintain an overall grade point average of 2.5 or better during the term of assistance under this program; (6) agree to practice education in a public school funded by the government of Guam in areas of need upon graduation and certification to practice on Guam. COL62201617 GCA EDUCATION CH. 18 YAMASHITA EDUCATOR CORPS 7 (A) If no vacant teaching positions exist in such public schools in his or her area(s) of certification, a T eacher Corps graduate may teach in a private school on Guam towa rds meeting their Teacher Corps scholarship repayment obligatio ns. The Department of Education and the Guam Community Coll ege shall certify that no vacancies in the Teacher Corps grad uate’s area(s) of certification exist prior to allowing private schoo l employment. (B) The length of commitment of service to Guam sh all be the total number of years that the student has rece ived the scholarship and financial assistance. (C) Only teaching service in public schools funded by the government of Guam and/or Guam private schools lice nsed by the government of Guam shall be credited for repayment of the Teacher Corps scholarship. (D) (i) Those Teacher Corps graduates who were all owed to teach in licensed private schools on Guam shall acc ept employment with the Department of Education ayment of the Teacher Corps scholarship. (D) (i) Those Teacher Corps graduates who were all owed to teach in licensed private schools on Guam shall acc ept employment with the Department of Education should a position in their area(s) of certification become a vailable at the start of each semester until such time that the ir scholarship is repaid. The Department of Education and the Guam Community College shall provide each eligible graduate a notice of available position at least th irty (30) days prior to the required date of employment. (ii) The student further agrees that, in the event of refusal to fulfill this obligation, the student sha ll repay the government of Guam an amount equal to the balance o f the total monthly allowances paid to the student which have not already been satisfied through service or payment, including tuition, stipends and the actual cost to the govern ment of textbooks and supplies. This section was originally added by P.L. 21-088:2 (Jan. 27, 1992), entitled ' Teacher Training Council ,' which was reenacted as 3 GCA § 9116 by P.L. 31-2 55:2 (Dec. 11, 2012). § 18202. Guam Teacher Corps Scholarship and Financi al Assistance Program. (a) Students in the program must complete an applic ation form provided by the School of Education and satisfy all the requirements set out in § 18101, supra . (b) A monthly allowance shall be paid to a person w ho is enrolled pursuant to the following tion form provided by the School of Education and satisfy all the requirements set out in § 18101, supra . (b) A monthly allowance shall be paid to a person w ho is enrolled pursuant to the following schedule: (1) college freshman, Two Hundred Dollars ($200.00) per month; during the period the person is classified a cademically as a sophomore, Three Hundred Dollars ($300.00) per mont h; during the period the person is classified academically as a j unior, Four Hundred Dollars ($400.00) per month; and senior and above s tanding, Five Hundred Dollars ($500.00) per month. The stipends for Teacher Corps scholarship recipients whose study concentrations a re in special education, early childhood education, Chamorro lang uage instruction, or secondary education or related major with concen tration in science or mathematics shall be one hundred twenty-five per cent (125%) of the amounts herein. (3) As a condition for continuing full entitlement to the benefits provided in this Chapter, with the exception of hig h school seniors, undergraduate recipients must (A) maintain a full-time enrollment of twelve (12) semester credits minimum per semester, (B) six (6) semester credits per summer session, a nd (C) good academic standing with a grade point aver age of 2.5 or better. ll-time enrollment of twelve (12) semester credits minimum per semester, (B) six (6) semester credits per summer session, a nd (C) good academic standing with a grade point aver age of 2.5 or better. Notwithstanding any other provision of law, administrative rules and regulations, School A ides, Library Technicians, Limited-Term Teachers with a bachelors degree or higher who are seeking teacher certification, and Chamorro Language Teachers whom do not have a bachelors degree, that are employed by the Department of Education, may qualify for financ ial assistance through the Guam Teacher Corps and may: (A) continue such employment while enrolled in the Guam Teacher Corps; and (B) enroll in the Guam Teacher Corps on a part-time basis. A letter of recommendation from the applicant's supervisor attesting to the applicant's job duties shall be required. (c) Registration, tuition and other related fees no rmally assessed by the University and an allowance not to exceed the amoun t of Two Hundred Fifty Dollars ($250.00) shall be allowed per regular seme ster, and One Hundred Dollars ($100.00) per summer session in which a per son is enrolled to cover costs of textbooks and supplies. (a) The Educator Corps Council may award Teacher C orps scholarships to individuals possessing a baccalaure ate degree in a course of study other than education for the purpose of meeti ng teacher certification requirements. (b) The scholarships awarded under this Section sh all be based on the recruitment needs of the Department of Education/Gu am Community College and shall be limited to a period of time no t to exceed two (2) years. (a) The Educator Corps Council may award Teacher C orps scholarships beyond the four (4) year limitation of § 18202 for individuals to seek graduate training, that may include a masters degree, for teaching specialties that require training beyond a baccalau reate degree. (2) The scholarships awarded under this Section sh all be based on the recruitment needs of the Department of Educatio n/Guam Community means for existing teachers to me et promotional requirements. (b) The Educator Corps Council may, based on the n eeds of the Department of Education or the Guam Community Colle ge for specialist teachers, authorize part-time scholarships if the p rospective scholarship recipient is a teacher with the Department of Educa tion or the Guam Community College. The Educator Corps Council may award Teacher Corps Scholarships to individuals majoring in a course of study other tha n education; provided, that such course of study meets the requirements for con centration and certification in a subject related to secondary edu cation and that such individuals, in addition to courses required for th eir major, complete the minimum courses required for teacher certification in secondary education. The stipend amounts and repayment terms shall be th e same as education majors under the provision of this Article. § 18203. Academic Advisor and Program Contract. Each Teacher Corps program participant shall have a n academic advisor who, with the student, shall develop a comp lete academic plan that would result in the granting of a teaching degree w ithin a normally prescribed period of time. The School of Education shall prioritize the granti ng of Teacher Corps Scholarships according to the teaching needs (subje ct area) as identified by the Department of Education and the Guam Community College. § 18205. Prior Rules and Law Shall Apply to Applica nts Currently in the Program or Under Repayment Status. Conditions of Acceptance. Educators accepted into this program herein shall a gree to the following conditions: (a) To successfully complete the courses; (b) That the educator will remain employed by the D epartment of Education in the position for which the ram herein shall a gree to the following conditions: (a) To successfully complete the courses; (b) That the educator will remain employed by the D epartment of Education in the position for which the educator is seeking recertification for a period of not less than one ( 1) semester for every three (3) credits of support received herein; (c) Present an eligibility certificate from the Dep artment of Education that includes the educator’s present teac hing concentration; (d) Comply in a timely fashion with the Department of Education certification requirements; and (e) Agree to repay the Dr. Antonio C. Yamashita Edu cator Corps for benefits provided if the conditions of this Sec tion are not met. § 18608. Funding. Funding for the Dr. Antonio C. Yamashita Educator C orps to administer and conduct the program in this Article may come from any or all of the following sources: (a) Direct appropriation by I Liheslaturan Guåhan f or the express purpose of funding the program created by this Arti cle; (b) Appropriations made to the Dr. Antonio C.
