Drug Free School Zone means any area within one thousand (1,000) feet of a public or private elementary, secondary or post secondary educational institution or its accompanyin g grounds; or within the vehicle of any school bus which transports students while in motion; or within two hundred fifty feet (250 =) of any school bus not in motion or a designated school bus stop or shelter, including any school bus transfer station. Notwithstanding the provisions of this Section, a Drug Free School Zone shall not include private real property which is not a school or the accompanying grounds of a school. Any person who commits an offense under Chapter 67 of Title 9 of the Guam Code Annotated within the Drug Free School Zone shall be in violation of this Chapter and punished in accordance with Article 4, Chapter 67 of Title 9 of the Guam Code Annotated. The following provisions shall apply relat ive to the coordina tion, establishment, and designation of drug free school zones: (a) It shall be the responsibility of schools, both public and private , and their respective governing boards or their designees, or the chief COL 11060917GCA EDUCATION CH.48DRUG FREE SCHOOL ZONES ACT 2administrative officer in the case of private schools, to coordinate the establishment and designation of the drug free school zones. (b) The respective governing boards of the schools, or the chief administrative officer in the case of private schools, shall place and maintain perma nently esignation of the drug free school zones. (b) The respective governing boards of the schools, or the chief administrative officer in the case of private schools, shall place and maintain perma nently affixed and plainly visible signs at the main entrances of each school which identify the school and its accompa nying grounds as a drug free school zone and which outline the penalties associated with violations of the Drug Free School Zones Act. T he respective governing boards of the schools, or the chief administrative officer in the case of private schools, shall determine the actual size of such signs. (c) Upon enactment, a copy of the Drug Free School Zones Act shall be transmitted to the respe ctive governing boards, or the chief administrative officers in the case of private schools, and it shall be their responsibility, at their discretion, to disseminate the informa tion to parent groups and to the community. (d) The respective governing boar ds of the schools, or the chief administrative officer in the case of private schools, shall transmit to the Legislature, within ninety (90) days, a status report on the establishment and designation of the drug free school zones f administrative officer in the case of private schools, shall transmit to the Legislature, within ninety (90) days, a status report on the establishment and designation of the drug free school zones within their respective jurisdictions. NOTE : P.L. 26 -125:3(d) provides: A new ninety (90) day period for re -designation of Drug Free School Zones is hereby established pursuant to 17 G.C.A. '48003 commencing the effective date of enactment of this Act. The effective date was 9/04/2002. § 48004. Drug Free School Zone Maps. The respective governing boards of the schools or their designees, or the chief administrative officer in the case of any private school, shall prepare drug free school zone maps for their respective jurisdiction s and shall submit copies of the original maps to the Office of the Attorney General as well as to the Department of Land Management for the purpose s of record -keeping. These shall constitute the official record as to the location and boundaries of each dr ug free school zone. The respective governing boards of the schools or their designees, or the chief administrative officer in the case of any private school, shall notify the Office of the Attorney ug free school zone.
