COL124201522 GCA BUSINESS REGULATIONS CH. 32 PROFESSIONAL ENGINEERS , ARCHITECTS AND LAND SURVEYORS 2 § 32101. Name. This Chapter may be cited as the Professional Engineers, Architects and Land Surveyors Law. § 32102. General Provisions. In order to safeguard life, health, and property, a nd to promote the public welfare, the practice of engineering, archit ecture, landscape architecture and land surveying in Guam is hereby d eclared to be subject to regulation in the public interest. It shall be unlawful for any person to practice or to offer to practice engineering, architecture, la ndscape architecture or land surveying in Guam as defined in the provision s of this Chapter or to use in

The practice of engineering, architecture , landscape architecture and land surveying shall be deemed a privilege granted by the government of Guam through the Guam Board of Registration for Pro fessional Engineers, Architects, Landscape Architects and Land Surveyors , based on the qualifications of the individual as evidenced by hi s certificate of registration which shall not be transferable. § 32103. Definitions. For the purpose of this Chapter, words used in the masculine gender include the feminine, or vice-versa, where appropriate. (a) Engineer. (1) E ngineer means a person who, by reason of his special knowledge and use of the mathematical, physical and engineering sciences and the principles and

(6) Practice of Engineering means any service or creative work, the adequate performance of which requires en gineering education, training, and experience in the applicat ion of special knowledge of the mathematical, physical, and engine ering sciences to such services or creative work as consultation, investigation, expert technical testimony, evaluati on, planning, design, and design coordination of engineering work s and systems, planning the use of land, air and water, t eaching of advanced engineering subjects, performing engineeri ng studies and the review and/or management of construction fo r the purpose of monitoring

A person shall be construed to practice or offer to practice engineering, within the meaning and intent of this Chapter, who practices any branch of the profession of engineeri ng or who, by verbal claim, sign, advertisement, letterhead, card , or in any other way represents themselves to be a professional engi neer or through the use of some other title implies that th ey are a professional engineer or that they are licensed under this Chapter; or who hold themselves out as able to perform, or w ho does perform any engineering service or work or any other service designated by the practitioner which is recognized as engineering. (7) Consulting Engineer means a professional engineer whose principal occupation is the independent pract ice of engineering; whose livelihood is obtained by offeri ng engineering services to the public; who services clients as an independent fiduciary; who is devoid of public,

This practice shall include the location, arrangements, and design of such tangible objects a nd features as are incidental and necessary for the pu rposes outlined herein. Nothing herein shall preclude a d uly registered landscape architect from planning the de velopment of land areas and elements used thereon or from per forming any of the services described in this Section in co nnection with the settings, approaches, or environment for b uildings, structures, or facilities.

(i) Certificate of Authorization means those presents issued by the Guam Board of Registration for Professional Eng ineers, Architects and Land Surveyors to a corporation, partnership, p roprietorship, limited liability company, or other legal entity al lowed by Guam law, the name of that organization which serves to ident ify it as having the legal right to offer engineering, architectural, la ndscape architectural, land surveying or construction

(o) IDP means the Intern Development Program prepared and issued by the NCARB.

(v) Registrant or Licensee means any person holding a current registration as a Professional Engineer, Registered Architect, Landscape Architect or Professional Land Surveyor. Reviewing, or reviewing and correcting, technical s ubmissions after they have been prepared by others does not constitute the exercise of responsible control because the reviewer has neithe r control over, nor detailed professional knowledge of, the content of such submissions throughout their preparation. (x) Responsible Managing Employee means a person who is licensed under this Chapter and who has been design ated, pursuant to § 32123 of this Chapter, by the firm. (y) Rules of Professional Conduct for Professional Engi neers, Architects, Landscape Architects, and Land Surveyor s means those rules promulgated by the Board as authorized by law .

(a) The Board shall consist of seven (7) members, at least two (2) being female, to be constituted as follows: the Dir ector of Public Works, five (5) members who shall be registered under the provisions of this Chapter and one (1) member of the general p ublic who shall not have been

(c) Each member of the Board shall receive a notice of his appointment from I Maga’lahen Guåhan (Governor) and shall take an oath for the faithful discharge of his duties. A separate seal of a p rofessional engineer of the appropriate branch of engineering, as such branches are designated on the various forms of pro fessional engineer registration certificates, and is required for each portion of such document that involves a separate branch of engineering, except as provided in sub-item (B) of this item (8). I also certify that all the monument s are of the character and occupy the positions indicated in this map'.

Such guidelines shall be consistent with items (8) and (9) of this Subsection (d), incl uding the requirements in those items for separate seals per branch of eng ineering and for the seal of an architect, in the case of a building whi ch has as its principal purpose human occupancy or habitation. (12) An Engineer, Architect, Landscape Architect an d Land Surveyor shall provide construction contract administration when applications are made for building or construction permits involving the public safety and health. The term 'construction co ntract administration' means making periodic visits to the site by a registered engineer, architect, landscape architect or land su rveyor, or

(13) Building Official: The Building Official charg ed with the responsibility of issuing building permits, must be in possession of a signed/sealed set of plans and specifications. § 32117. Expirations and Renewals. (a) Certificates of Registration shall expire on the last day of the month of April, and

(2) Expired Certificates of Registration may be renewed at any time within sixty (60) days following the expiratio n date without submission of an 'Application for Reinstatement', u pon payment of the renewal fee plus the penalty fee as

The Attorney General may commence a civil action to recover the amount of the penalty, plus attorney’s fees and costs. (8) An action to enforce an order under this Sectio n may be combined with an action of an injunction. (b) Criminal Offenses (1) Any person who shall practice, or offer to practice, engineering, architecture, landscape architecture or land surveying on Guam without being registered in accordance with th e provisions of this Chapter, or any person, firm, partnership, organization, association, corporation or other entity using

(c) A multi-discipline firm who has more than one ( 1) designated RME shall be required to have a minimum of one (1) RME and w ho must have full control over the particular services cont racted for by the firm. (g) The Certificate of Authorization shall be renewed as herein provided in § 32117(a).

Contract Law Language. (a) A Professional Engineer, Architect, Landscape Architect, or Land Surveyor shall use a written contract when contracting to provide professional engineering, architecture, landscape a rchitecture, land surveying or construction management services to a client pursu ant to this Chapter. The written contract shall be executed by the professional engineer, architect, landscape architect, or land surveyor and the client, or their representative, prior to the

This Chapter shall not be construed to prevent the practice by: (a) Temporary Permits. It shall be unlawful for the recorder of deeds or the civil registrar of titles to file or record any map, plat, survey or other documents, within the definition of land surveying, which do not have impressed thereon and affixed thereto the personal signature and seal of the professional land surveyor by whom or under whose direct supervision the map, plat, surv ey or other documents were prepared. § 32128. Invalid Sections. If any of the provisions of this Chapter, or if any rule, regulation or order thereunder, or if the application of such provision to any person or circumstance shall be held invalid, the remainder of this Chapter and the application of such provision of this Chapter or such rule,
