For purposes of this Chapter and unless otherwise s pecified, the following words and phrases are defined to mean: (a) Contract means the agreement or purchase order entered into between the winning bidder and the government of Guam. (b) Contractor shall mean the winning bidder who sh all be the signatory on the Contract, and shall be fully respo nsible for the purchase of equipment, the installation, permits of the installation of the equipment, and the first year of monitoring and maintenance of electronic security systems in the schools as outli ned in the Contract. The Contractor shall provide a warranty of at least 5 years, which will include a bi-annual testing of le nses for correct fields of view, to be adjusted as necessary, the re view of pictures for correct fields of view and any adjustments as neces sary, the testing of remote signaling equipment where applicable; the testing of recording and playback quality, as well as re view of pictures for correct fields of view and any adjustments as neces sary, the testing of remote signaling equipment where applicable; the testing of recording and playback quality, as well as reviewin g the satisfactory transmission of images to remote center and the rep air of any fault or other defects when necessary (part of warranty). The Contractor may cooperate with another entity or entities in an y manner the Contractor deems appropriate to accomplish the same . (c) Equipment shall mean the wiring, computer serve r, network video recorder devices, security cameras, a larm systems, and any and all other equipment relevant to the ins tallation and maintenance of the electronic security systems in t he schools. (d) Monitoring refers to a service provided by a th ird party to monitor the electronic security systems for up to t wenty-four (24) hours a day, seven (7) days a week, or as needed, t o be determined by the Guam Department of Education. (f) Schools shall mean all Guam public schools. (g) Risk Assessment means an assessment of each sch ool’s surveillance needs, whether by camera, closed circu it TV, or other electronic or non-electronic form ols shall mean all Guam public schools. The Contract shall require that the Contractor be r esponsible for all costs, expenses and fees of any kind or nature, ass ociated with the purchase of equipment, installation, and permits as sociated with the installation and maintenance of electronic security systems in the schools. The Contractor shall further be responsib le for the connection and payment of all utilities, including, but not li mited to power, telephone and cable, needed for the proper function ing of said electronic security systems. The Superintendent of Education shall perform, or c ause to be performed, a risk assessment that determines each s chool’s needs for an appropriate school security system for all the scho ol campuses of the Guam Department of Education. The expedited procure ment as authorized in § 58C104 or any procurement of an ele ctronic security system for the school campuses of the Guam Departme nt of Education utilizing public funds shall not occur until the st udy required by this Section is submitted to I Liheslaturan Guåhan .
