§321-604 Manufacturers of class B firefighting foam; prohibitions; certificate of compliance; penalty. (a) A manufacturer of class B firefighting foam prohibited by this part shall notify, in writing and no later than January 1, 2023, persons that sell the manufacturer's products in the State about the requirements of this part. (b) A manufacturer that produces, sells, or distributes a class B firefighting foam prohibited by this part shall recall the product and reimburse the retailer or any other purchaser for the product. (c) The department may request a certificate of compliance from a manufacturer of class B firefighting foam that attests that a manufacturer's product or products meets the requirements of this part. (d) Any manufacturer of class B firefighting foam violating this part or any rule adopted pursuant to this part shall be subject to an administrative fine not to exceed: (1) $5,000 for a first violation; and (2) $10,000 for any subsequent violation.
