A patient shall be discharged or transferred from a state institution to the least restrictive setting:(1) when the discharge or transfer is appropriate to the patient's unique needs;(2) to prevent unnecessary and inappropriate hospitalization; and(3) in accordance with standards of professional practice.As added by P.L.40-1994, SEC.54.
