(a) A person may not start:(1) construction of a confined feeding operation; or(2) expansion of a confined feeding operation that increases:(A) animal capacity; or(B) manure containment capacity; or(C) both;without obtaining the prior approval of the department.(b) A person may not operate a confined feeding operation without obtaining the prior approval of the department.[Pre-1996 Recodification Citation: 13-1-5.7-2.]As added by P.L.1-1996, SEC.8.
