(b) The department shall:(1) produce an annual report on the state of the environment; and(2) develop proposed rules that:(A) provide for the legitimate use of solid and hazardous waste instead of its disposal; and(B) provide that a material being legitimately used is not considered a solid or hazardous waste.(c) To become effective, any proposed rules developed under subsection (b)(2) must be adopted by the board under IC 13-19-3-1.[Pre-1996 Recodification Citation: 13-7-1-1(c).]As added by P.L.1-1996, SEC.9.
