The active area of a composting facility may be located less than two hundred (200) feet from a residence if:(1) no unit of local government with jurisdiction over:(A) the residence; or(B) the composting facility;has adopted an ordinance under section 5 of this chapter or IC 13-7-35-6(b) (before its repeal); and(2) the composting facility obtains written consent from the occupant and the owner of the residence.[Pre-1996 Recodification Citation: 13-7-35-6(c).]As added by P.L.1-1996, SEC.10.
