The commissioner may proceed in the appropriate court to recover costs and damages from a person who:(1) is responsible for the improper storage of waste tires; and(2) fails, without sufficient cause, to properly undertake a removal or remedial action under section 13 of this chapter.[Pre-1996 Recodification Citation: 13-7-23-18 part.]As added by P.L.1-1996, SEC.10.
