The state or a unit of local government may commence a civil action against an owner or operator of a facility for failure to do any of the following:(1) Provide notification to the emergency response commission under section 3 of this chapter.(2) Submit a material safety data sheet or a list under section 8 of this chapter.(3) Make available information requested under section 8 of this chapter.(4) Complete and submit an inventory form under section 9 of this chapter containing tier I information unless the requirement does not apply under section 9(b) of this chapter.[Pre-1996 Recodification Citation: 13-7-37-20(b).]As added by P.L.1-1996, SEC.15.
