§ 13-26-9-2

The granting of a certificate of territorial authority to a sewage disposal company under IC 8-1-2-89 for a territory lying in the territory of a district may be conditioned upon the following requirements:(1) That the sewage disposal company connect the company's collection system to the collection system of a district when the district has extended to within three hundred (300) feet of the territorial area of the sewage disposal company a system sufficient to provide reasonable and adequate service to the territorial area.(2) That the sewage disposal company contribute the company's collection system to the district instead of all connection charges that could otherwise be imposed under this article upon:(A) the sewage disposal company; or(B) those parcels and lots served by the collection system of the sewage disposal company that have been contributed by the company to the district.[Pre-1996 Recodification Citation: 13-3-2-7(b).]As added by P.L.1-1996, SEC.16.
