The commission may acquire by appropriation under Indiana eminent domain law:(1) any land, property, rights, rights-of-way, franchises, easements, or other interests in real property, including land under water and riparian rights; or(2) any existing facilities, betterments, and improvements, or other property;necessary and proper for the creation, development, establishment, maintenance, or operation of a project or any part of a project.[Pre-1995 Recodification Citation: 14-6-29.5-5(b).]As added by P.L.1-1995, SEC.6.
