However, the offense is:(1) a Class A misdemeanor if the accident or collision results in an injury to a person;(2) a Level 6 felony if:(A) the accident or collision results in serious bodily injury to a person; or(B) within the five (5) years preceding the commission of the offense, the person had a previous conviction of any of the offenses listed in IC 9-30-10-4(a), IC 35-46-9-6, or IC 14-15-8-8 (before its repeal); or(3) a Level 5 felony if the accident or collision results in the death of a person.[Pre-1995 Recodification Citation: 14-1-1-59 part.]As added by P.L.1-1995, SEC.8.
