The director may consider information relating to the following:(1) Population.(2) Distribution.(3) Habitat needs.(4) Limiting factors.(5) Other biological and ecological data.(b) On the basis of the determination made under subsection (a), the director shall adopt rules that do the following:(1) Designate the species or subspecies of nongame species that the director considers in need of management under this section, giving the common and scientific names by species and subspecies.(2) Develop management programs designed to ensure the continued ability of nongame species in need of management to perpetuate themselves successfully.(c) The director shall conduct ongoing investigations of nongame species to determine if the rules need to be amended.[Pre-1995 Recodification Citation: 14-2-8.5-2.]As added by P.L.1-1995, SEC.15.
