The owner of a levee, dike, or floodwall and appurtenant works shall maintain and keep the structures and appurtenant works in the state of repair and operating condition required by the following:(1) The exercise of prudence.(2) Due regard for life or property.(3) The application of sound and accepted engineering principles.[Pre-1995 Recodification Citation: 13-2-20-2.]As added by P.L.1-1995, SEC.20.
