If the county executive and county fiscal body of a county without a general county hospital determine that the county has insufficient hospital facilities, the county may give financial aid for the construction, equipment, and improvement of a nonprofit hospital that meets the following conditions:(1) Is operated for charitable purposes.(2) Is owned and operated by at least one (1) hospital association or owned by a governmental unit in the county and operated by a hospital association.(3) Does not limit the membership and officers of the hospital association to residents of a certain section of the county.(4) Has a governing board of the hospital association that meets the following conditions:(A) Is nonsectarian and nonpolitical.(B) Is chosen by election by the members of the association.(C) Includes the following:(i) One (1) member designated by the county executive.(ii) One (1) member designated by the county fiscal body.(iii) One (1) member who may be a licensed physician.[Pre-1993 Recodification Citation: 16-12-17-1(a) part.]As added by P.L.2-1993, SEC.5.
