If the department:(1) does not receive a satisfactory response to a request for proposals under section 2(a)(1) of this chapter; and(2) is unable to enter into a memorandum of understanding under section 2(a)(2) of this chapter;the department is not required to contract with a company or enter into a memorandum of understanding as provided under section 2 of this chapter.As added by P.L.140-2022, SEC.2.
