If the superintendent of the school corporation that is the local education agency determines that:(1) a qualified licensed teacher is not available from the entities entering into an agreement under section 5 of this chapter; and(2) a qualified postsecondary instructor is available;to instruct in an educational program described in section 7 of this chapter, the superintendent may request the department to issue a substitute teacher's license to the instructor of an educational program described in section 7 of this chapter.[Pre-2005 Elementary and Secondary Education Recodification Citation: 20-10.1-7-12.5.]As added by P.L.1-2005, SEC.14.
