Notwithstanding the requirements of this chapter, any decisions made with regard to:(1) attendance in a remediation program;(2) statewide assessment program testing; and(3) the grade level placement;for a student who is a student with a disability (as defined in IC 20-35-1-8) shall be made in accordance with the individualized education program, state law, and federal law.[Pre-2005 Elementary and Secondary Education Recodification Citation: 20-10.1-17-10.]As added by P.L.1-2005, SEC.16.
