(a) Immediately upon abandoning the use of heating oil as a fuel in heating a property, the owner of a heating oil tank, under applicable state and federal law, shall:(1) remove all flammable or combustible liquids from the heating oil tank, piping, and connections; and(2) except as provided under subsection (b), remove the outside filling pipe.(b) An owner is not required to remove an outside filling pipe under subsection (a)(2) if the owner permanently secures the tank against accidental filling.(c) An owner of a heating oil tank described in subsection (a) shall, under applicable state and federal law, dispose of all flammable and combustible liquids removed under subsection (a).As added by P.L.131-1997, SEC.7.
