If an insurer cancels or declines to renew a group accident and sickness policy for reasons other than fraud or nonpayment of a premium and issues a new policy to the policyholder within one (1) year after the effective date of cancellation of the policy, the insurer must accept for coverage under the new policy an individual who:(1) was covered under the old policy; and(2) has continued to meet the requirements for membership in the group that applied to the old policy. However, the insurer may not exclude or limit the coverage to the individual or individual's dependent due to evidence of insurability. As added by P.L.125-1992, SEC.4.
