§ 3-6-1-14

An action brought under section 13 of this chapter:(1) must be commenced, prosecuted, and tried in the circuit or superior court of the county where the defendant resides;(2) shall be tried by the court without a jury;(3) has precedence over all other cases pending in the court, except murder trials; and(4) may not be venued from the county.Process shall be served and proceedings conducted as in other civil actions, except that process shall be returned three (3) days from the date of service.
